Functioning of the common market of cosmetics within the EAEU is carried out in accordance with the Agreement on the Eurasian Economic Union of May 29, 2014, Decision of the Customs Union Commission of May 28, 2010 № 299 “Unified sanitary-epidemiological and hygienic requirements for products (goods) subject to sanitary and epidemiological supervision (control), as well as in accordance with the acts of the Eurasian Economic Commission in the circulation of cosmetic products.
Cosmetic products are subject to state registration under the “centralized” procedure according to the EAEU Technical Regulations, the main of which is Technical Regulation 009/2011 “On the Safety of Perfumery and Cosmetic Products”. Registration gives the right to place products in the markets of all member states of the Eurasian Economic Union: Belarus, Russia, Kazakhstan, Armenia and Kyrgyzstan. However, national language and labelling requirements should be taken into account.
Perfumery and cosmetic products (PCP) are products intended to be applied directly to the external cover of the human body (skin, hair, nails, lips and external sexual organs) or to the teeth and oral mucous membrane with the sole or main purpose of cleaning, changing the appearance, giving a smell, and/or protecting, and/or preserving in a physiological state, and/or taking care of them.
State registration of perfumery and cosmetic products of foreign production is performed before import into the customs territory of the EAEU.
Common mark of the product circulation on the EAEU market must be affixed on the cosmetic product prior to it’s placing on the market. The mark is affixed to the package of each individual product, and indicates compliance with the requirements of all applicable EAEU Technical Regulations and passing the assessment of conformity. |
The manufacturer, Applicant and importer shall be responsible for the quality and safety of cosmetic products and for compliance with the requirements of Technical regulations.
Registration (assessment of conformity) of the cosmetic product should be initiated by the Applicant, resident of the EAEU member state. The Applicant shall be obliged to ensure conformity of cosmetic products to the requirements established by all applicable Technical regulations of the EAEU.
Before starting the authorization procedure we advice to perform feasibility study: to check the documentation on the product for compliance with the requirements of the EAEU Technical Regulations:
- composition requirements,
- requirements for physical and chemical indicators,
- requirements for microbiological indicators,
- requirements for the content of toxic elements,
- toxicology requirements,
- requirements for clinical (clinical and laboratory) indicators,
- manufacturing requirements,
- requirements for consumer packaging,
- labelling requirements.
Declaration of conformity of perfumery and cosmetic products
Before starting the declaration procedure it is necessary to conduct research (testing) of samples of perfumery and cosmetic products in an accredited testing laboratory in the territory of an EAEU Member State.
Thus, the declaration procedure can be presented in such steps:
- Carrying out researches (tests) on samples in an accredited testing laboratory;
- Examination of the Application, results of studies (tests) and other necessary documents which confirm safety and conformity of the products to the requirements of the EAEU Technical regulations;
- Registration of the declaration with an accredited body.
Registration of perfumery and cosmetic products
List of products to be registered:
- Perfumery and cosmetic products for artificial tanning;
- Perfumery and cosmetic products for skin whitening/lightening;
- Perfumery and cosmetic production of individual protection of a skin from influence of negative industrial factors;
- Perfumery and cosmetic production for chemical colouring, clarification and melioration of hair;
- Perfumery and cosmetic production for chemical curling or hair straightening;
- Perfumery and cosmetic production for depilation;
- Perfumery and cosmetic production for peeling;
- Cosmetics for a tattoo (except for means for a tattoo, put with infringement of a skin cover);
- Intimate cosmetics;
- Cosmetics for children;
- Oral fluoride products (fluorides ≥ 0.15% for hard and soft products; fluorides ≥ 0.05% for liquid products);
- Tooth whitening products (with a concentration of hydrogen peroxide of 0.1-6.0%);
- Perfumery and cosmetic products made with the use of nanomaterials.
Before starting the registration procedure it is necessary to conduct research (tests) of samples of perfumery and cosmetic products in an accredited testing laboratory in the territory of an EAEU Member State. Thus, the procedure of state registration can be presented in such stages:
- Conducting research (tests) on samples in an accredited testing laboratory;
- Expert examination of the Application, results of studies (tests) and other necessary documents which confirm safety and conformity of the products to the requirements of the EAEU technical regulations;
- Entering information into the unified register of products and obtaining a certificate of registration
State registration of perfumery and cosmetic products is issued without expiry (or until changes in the name and/or formulation of products are made) and is valid in the territory of all EAEU Member States: Belarus, Russia, Kazakhstan, Armenia and Kyrgyzstan.
